By accessing or using RPT Motorsports services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

These terms constitute a legally binding agreement between you and RPT Motorsports. We reserve the right to modify these terms at any time, and your continued use of our services constitutes acceptance of any changes.

Tuning Services: We provide vehicle performance tuning services including dyno tuning, remote tuning, and custom calibration development for supported vehicles.

Installation Services: We offer professional installation of performance modifications, custom fabrication, and related automotive services.

Consultation Services: We provide technical consultation, performance planning, and project management services for vehicle modifications.

Support Services: We offer ongoing technical support, troubleshooting assistance, and guidance for customers who have used our services.

Accurate Information: You must provide accurate, complete, and truthful information about your vehicle, modifications, and intended use.

Legal Compliance: You are responsible for ensuring that any modifications comply with local, state, and federal laws and regulations in your area.

Proper Use: You agree to use our services only for their intended purpose and in accordance with all applicable laws and safety guidelines.

Payment: You agree to pay all fees and charges associated with the services provided in accordance with our payment terms.

Vehicle Condition: Your vehicle must be in good mechanical condition and suitable for the requested modifications.

No Guarantees: While we strive for excellent results, we cannot guarantee specific power gains, performance improvements, or outcomes from our services.

Vehicle Compatibility: Not all modifications are suitable for all vehicles. We reserve the right to refuse services if we determine they are unsafe or unsuitable.

Environmental Factors: Performance results may vary based on environmental conditions, fuel quality, vehicle condition, and other factors beyond our control.

Support Limitations: Technical support is provided on a best-effort basis and may be limited for vehicles with modifications from other sources.

Payment Due: Payment is due upon completion of services unless other arrangements have been made in writing.

Deposits: Some services may require a deposit before work begins. Deposits are non-refundable once work has commenced.

Late Payment: Late payment may result in suspension of support services and additional fees as permitted by law.

Disputed Charges: Any billing disputes must be raised within 30 days of the invoice date.

Payment Methods: We accept various payment methods as specified during the service booking process.

Service Warranty: We warrant that our services will be performed in a professional and workmanlike manner. This warranty is limited to correcting defects in our workmanship.

Parts Warranty: Parts supplied by us carry the manufacturer's warranty. We do not provide additional warranties on parts beyond those provided by the manufacturer.

Warranty Limitations: Warranties do not cover damage resulting from misuse, normal wear and tear, modifications by others, or failure to follow maintenance recommendations.

Warranty Claims: All warranty claims must be made promptly and in writing. We reserve the right to inspect any claimed defects.

Maximum Liability: Our total liability for any claim shall not exceed the amount paid for the specific service in question.

Consequential Damages: We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of use, or additional repair costs.

Time Limitation: Any claim against RPT Motorsports must be brought within one year of the date the services were completed.

Force Majeure: We shall not be liable for delays or failures in performance resulting from circumstances beyond our reasonable control.

Our Property: All tune files, calibrations, procedures, and methodologies developed by RPT Motorsports remain our exclusive property.

License to Use: We grant you a non-exclusive, non-transferable license to use our tune files solely in your vehicle for which they were developed.

Restrictions: You may not copy, modify, distribute, sell, or reverse engineer our tune files or proprietary information.

Third-Party Rights: We respect the intellectual property rights of others and expect our customers to do the same.

Right to Terminate: We reserve the right to terminate or refuse services at any time for any reason, including violation of these terms.

Effect of Termination: Upon termination, your right to use our services and any associated materials ceases immediately.

Refunds: Refunds, if any, will be determined on a case-by-case basis and in our sole discretion.

Survival: Provisions regarding payment, warranties, liability limitations, and intellectual property survive termination.

Governing Law: These terms are governed by the laws of the state where our business is located, without regard to conflict of law principles.

Dispute Resolution: Any disputes arising from these terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Jurisdiction: Any legal proceedings must be brought in the courts located in our home jurisdiction.

Class Action Waiver: You waive any right to participate in class action lawsuits against RPT Motorsports.
